Terms of Service

These terms are the agreement between you and EinShine, Inc. ("ieBizSites," "we," "us") when you use our service. We've written them in plain English. By starting a free trial or subscribing, you agree to them.

1. What you get

The ieBizSites subscription includes: a pre-built, hosted website for your business; ongoing hosting, security, and backups; content updates on request (just email us); and a .com domain that we register and manage for you. It's a straightforward brochure-style website service — not a custom web-development or marketing agency engagement.

2. Free trial, pricing & billing

• Free 30-day trial. A valid payment card is required to start, but you are charged $0 at signup and nothing during the trial.
• Billing starts on day 31. When the trial ends, your plan begins: $29 per month, or $299 per year if you chose annual.
• Automatic renewal. Your subscription renews automatically — monthly or annually, depending on your plan — at the price above, using the card on file, until you cancel. We'll email you a reminder before your free trial converts to a paid plan.
• Prices are in U.S. dollars and exclude any applicable taxes. Payments are processed by Square; we don't store your full card details.

3. Cancelling — easy and self-service

You can cancel at any time, yourself, online from your management page — no phone call or email required. Request a secure link, and cancel in a couple of clicks.

• Cancel during the free trial and you are never charged — $0.
• Cancel during a paid period and your site stays live through the end of the period you've already paid for; it then comes down. We don't charge you again after you cancel.
• We don't provide prorated refunds for partial periods, but you keep the service you've paid for until it ends.

4. Your .com domain

As part of your subscription, we register and manage a .com domain for you and point it at your site.

• The domain is registered in our account, on your behalf, with WHOIS privacy enabled. We manage it as part of the service, and it's yours in the sense that it's dedicated to your business and used only for your site.
• If you ever leave, we will transfer the domain to you free of charge on request. Note that new domain registrations carry an ICANN-mandated 60-day transfer lock, so a transfer can only be completed after that window.
• Because domains are registered and paid for up front for a full year, domain registration fees are non-refundable.

5. Content & ownership

Your business's own information and any content you provide (your name, photos, hours, corrections, etc.) remain yours. You grant us permission to use that information to build, host, and update your site. The website template, design system, software, and platform remain the property of EinShine, Inc. The factual business details shown on your site are drawn from publicly available sources; if anything is inaccurate, tell us and we'll fix it.

6. Acceptable use

You agree to use the service lawfully and not to use your site for anything illegal, fraudulent, deceptive, or that infringes others' rights. You are responsible for the accuracy of information you ask us to publish and for having the right to use any content you provide.

7. What we don't promise

We want to be honest about what this service is and isn't:

• No ranking or SEO guarantees. We build sites designed to be found, but we do not promise any particular Google ranking, search traffic, leads, or sales.
• No formal uptime guarantee. We work hard to keep sites online and take regular backups, but we do not offer a contractual uptime SLA. Occasional maintenance or outages can happen.
• The service is provided on an "as is" and "as available" basis, without warranties beyond those that cannot be disclaimed under law.

8. Suspension & termination

You can cancel anytime as described above. We may suspend or terminate a site that violates these terms, is used for abuse or illegal activity, or where payment fails and isn't resolved. Where practical, we'll give you notice and a chance to fix the issue first.

9. Limitation of liability

To the fullest extent allowed by law, EinShine, Inc. is not liable for indirect, incidental, or consequential damages, or for lost profits or revenue, arising from your use of the service. Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim. Some jurisdictions don't allow certain limitations, so parts of this may not apply to you.

10. Governing law

These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any disputes will be handled in the state or federal courts located in California.

11. Changes to these terms

We may update these terms from time to time. If we make a material change, we'll update the "Last updated" date and, where appropriate, notify you. Continuing to use the service after a change means you accept the updated terms.

SMS text notifications

If you opt in, we may send optional SMS/text alerts about your account (such as sign-ups, payment issues, and system status) to the mobile number you provide. Message frequency varies, and message and data rates may apply. Reply STOP to opt out or HELP for help at any time.
